一、适用对象

I. Target Applicants

(一)用人单位基本条件

(I) Basic Requirements for Employers

1.依法设立,有实际经营场所、依法纳税、缴纳社会保险、无严重违法失信记录;聘用外国人从事的岗位应是有特殊需要,国内暂缺适当人选,且不违反国家有关规定的岗位;支付所聘用外国人的工资、薪金不得低于当地最低工资标准。

1. The employer must be legally established, have a physical business premise, pay taxes and social insurance in accordance with the law, and have no record of serious law violations or dishonesty. The position offered to the foreign national must be of special need, with no suitable local candidates available temporarily, and must comply with relevant national regulations. The wage and salary paid to the foreign employee must not be lower than the local minimum wage and salary standard.

2.法律法规规定应由行业主管部门前置审批的,需经过批准。

2. If laws or regulations require prior approval by the competent industry authority, the employer shall obtain such approval.

(二)申请人基本条件

(II) Basic Requirements for Applicants

1.应年满18周岁,身体健康,无犯罪记录,境内有确定的用人单位,具有从事其工作所必需的专业技能或相适应的知识水平。

1. The applicant shall be at least 18 years old, in good health and with no criminal record, have a confirmed employer in China, and possess the professional skills or corresponding level of knowledge required for their work.

2.所从事的工作符合我国经济社会发展需要,为国内急需紧缺的专业人员。

2. The position shall align with China's economic and social development needs and be one in urgent demand.

3.法律法规对外国人来华工作另有规定的,从其规定。

3. If laws or regulations specify other conditions for foreigners working in China, such provisions shall apply.

4.外国高端人才(A类)是指符合“高精尖缺”和市场需求导向,中国经济社会发展需要的科学家、科技领军人才、国际企业家、专门特殊人才以及符合计点积分外国高端人才标准的人才(指经过“积分要素计分赋值表”打分,分数在85分及以上的申请人)。外国高端人才可不受年龄、学历和工作经历限制。

4. Category A – Foreign High-End Talent: Refers to highly educated, professionally competent, cutting-edge, and urgently needed" scientists, leading scientific or technological talent, international entrepreneurs, and specialized professionals who are aligned with market demand and meet China's economic and social development needs. Additionally, it also includes those who meet the points-based foreign high-end talent standards, meaning applicants who score 85 points or above in the "points-based evaluation table". These individuals are not subject to restrictions on age, academic qualifications, or work experience.

外国专业人才(B类)是指符合外国人来华工作指导目录和岗位需求,属于经济社会发展急需的人才,具有学士及以上学位和2年及以上相关工作经历,年龄上限按照我国法定退休年龄确定;对确有需要,符合上海市外籍“急需紧缺”人才岗位目录(试行)的外籍人才、创新创业人才、专业技能类人才、符合计点积分外国专业人才标准的(指经过“积分要素计分赋值表”打分,分数在60分及以上的申请人)以及执行政府间协议或协定的,可适当放宽年龄、学历或工作经历等限制。

Category B – Foreign Professional Talent: Refers to professionals who align with the "Catalogue for Guiding Foreigners Working in China" and specific job requirements, and who are in demand for China's economic and social development. Applicants must hold a bachelor's degree or higher and have at least 2 years of relevant work experience. The age limit is subject to China's statutory retirement age. For certain cases, such as those who meet the "Occupation List for Urgently Needed Foreign Talent in Shanghai (Trial)", foreign talent in innovation and entrepreneurship, skilled professionals, or those who meet the points-based foreign high-end talent standards, meaning applicants who score 60 points or above in the "points-based evaluation table", as well as personnel under intergovernmental agreements, the restrictions on age, education, or work experience may be relaxed appropriately.

具体见《外国人来华工作分类标准(试行)》《上海市外籍“高精尖”人才认定标准(试行)》《上海市外籍“急需紧缺”人才岗位目录(试行)》(上海国际人才网https://www.sh-italent.com)。

国家对专门人员和政府项目人员有规定的,从其规定。

5.符合下列情形之一的,可在境内申请《外国人来华工作许可》:

5. Any of the following circumstances shall be eligible for domestic application for the Foreigner's Work Permit in China:

(1)持其他签证或有效居留证件已入境的外国高端人才(A类);

(1) Foreign High-End Talent (Category A) who has entered China holding other valid visas or residence permits;

(2)在华工作的外国人变换用人单位,但工作岗位(职业)未变动,且工作类居留许可在有效期内的;

(2) Foreign nationals working in China who change employers but maintain the same job position (occupation), and whose work-related residence permit is still valid;

(3)中国公民的外籍配偶或子女、在华永久居留或工作的外国人的配偶或子女,持有效签证或在有效期内的居留许可的;

(3) Foreign spouses or children of Chinese citizens, or foreign spouses or children of foreigners with permanent residence or work status in China, holding valid visas or residence permits within the validity period;

(4)符合自由贸易区、全面创新改革试验区相关优惠政策的;

(4) Applicants eligible under preferential policies of Free Trade Zones or Comprehensive Innovation Reform Pilot Zones;

(5)用人单位符合享有跨国公司在华地区总部相关优惠政策的;

(5) Employers meeting the criteria for preferential policies applicable to regional headquarters of multinational corporations in China;

(6)企业集团内部人员流动的;

(6) Internal personnel transfers within corporate groups;

(7)执行政府间协议或协定的;

(7) Personnel covered under intergovernmental agreements or arrangements;

(8)已持工作签证依法入境的驻华机构代表人员;已获得来华工作90日以下的外国人来华工作许可,在其停留有效期内,被境内用人单位依法聘用的;

(8) Representatives of foreign organizations in China who have entered legally with a work visa; foreigners who have obtained a work permit for employment in China for up to 90 days, and are lawfully employed by a domestic employer during their authorized stay;

(9)近5年内,连续在华合法工作1年以上且信用良好的(含1年);

(9) Foreigners who have legally worked continuously in China for at least one year within the past five years and have maintained good credit (including exactly one year);

(10)其他审批机构认定符合条件的。

(10) Other cases recognized as eligible by relevant approval authorities.

二、所需材料

II.Required Documents

(一)境外申请《外国人来华工作许可》

(I) Overseas Application for the Foreigner's Work Permit in China

1.外国人来华工作许可申请表:入境前在线填写打印,申请人签字后,加盖用人单位公章或经单位授权部门公章上传至系统。

1. Application Form for the Foreigner's Work Permit in China: To be completed and printed online before entry. The applicant shall sign the form, which must then be stamped with the employer's official seal or the seal of the authorized department within the employer's organization, and uploaded to the system.

2.外国人才认定材料:应根据《外国人来华工作分类标准(试行)》《上海市外籍“高精尖”人才认定标准(试行)》《上海市外籍“急需紧缺”人才岗位目录(试行)》,提供符合认定条件的相关证明材料,由申请人在申请表中签字并加盖用人单位公章,同意许可决定机构根据需要进行补充调查。

2. Foreign Talent Certification Documents: According to the Classification Standards for Foreigners Working in China (Trial), Recognition Standards for Highly Educated, Professionally Competent, and Cutting-Edge Foreign Talent in Shanghai (Trial), and Occupation List for Urgently Needed Foreign T in Shanghai (Trial), applicants must provide relevant supporting documents that meet the certification requirements. The applicant must sign and the employer must stamp the application form to agree to allow the permit issuing authority to conduct additional investigations if necessary.

通过计点积分达到外国高端人才(A类)或外国专业人才(B类)标准的,应提供相应的最高学位(学历)证书、职业资格证明、汉语水平能力(中国汉语水平考试HSK证书等)、来华工作年薪的收入证明、工作资历证明材料以及计点积分表等材料。

Applicants who reach the points-based criteria for Foreign High-End Talent (Category A) or Foreign Professional Talent (Category B) shall provide the highest academic degree (qualification) certificate, professional qualification certificates, proof of Chinese language proficiency (such as the HSK certificate), proof of annual income for work in China, employment experience documentation, and the points-based evaluation table.

在涉及薪资事项申请时,应提交单位及申请人承诺书(承诺事项包括外国人的月薪(年薪)、在沪月(年)交税金额、缴税地点等,申请人签字,用人单位加盖公章),受理及决定机构可要求用人单位在办理下次业务时提供相应税单。

For applications involving salary matters, the employer and the applicant must submit a joint commitment letter. The letter should state the foreigner's monthly (or annual) salary, the amount of monthly (or annual) taxes paid in Shanghai, the tax payment location, and other related commitments. The applicant must sign the letter, and the employer must stamp it with the official seal. The acceptance and decision authority may request the employer to provide corresponding tax documents during the next application.

经有关部门推荐的外国高端人才(A类)或外国专业人才(B类),应提交获得上海市相关行业主管部门出具的办理外国人来华工作许可推荐函。

Foreign High-End Talent (Category A) or Foreign Professional Talent (Category B) recommended by relevant departments shall submit a recommendation letter issued by the relevant Shanghai industry authority for the foreigner's work permit application.

3.工作资历证明:由申请人原工作过的单位出具从事与现聘用岗位工作相关的工作经历证明,包括职位、工作时间或曾经做过的项目,需申请人原工作单位加盖公章或负责人签字,并留有证明联系人有效联系电话或电子邮件。符合计点积分外国人才标准的申请人需出具满足积分年限的工作经历证明。

3. Proof of Work Experience: Issued by the applicant's previous employer, this document must certify work experience related to the current employment position, including job title, duration of employment, or projects once undertaken. It must bear the official seal of the previous employer or the signature of a responsible person, and provide valid contact phone number or email of the certifying contact person. Applicants meeting the point-based foreign talent standards shall provide proof of work experience fulfilling the required points duration.

外国高端人才符合《外国人来华工作分类标准(试行)》《上海市外籍“高精尖”人才认定标准(试行)》外国高端人才(A类)(一)入选国内人才引进计划的;(二)符合国际公认的专业成就认定标准的外国高端人才,该项采用承诺制。其他达到外国高端人才(A类)标准的仍需提供工作资历证明。如申请人在专业领域知名奖项获奖,可提供相应获奖证明材料。符合《上海市外籍“急需紧缺”人才岗位目录(试行)》的外国专业人才(B类)应提交与条件相符的证明材料。

For foreign high-end talent who (I) is selected under domestic talent introduction programs or (II) meets internationally recognized professional achievement standards, as defined in the Classification Standards for Foreigners Working in China (Trial) and the Recognition Standards for Highly Educated, Professionally Competent, and Cutting-Edge Foreign Talent in Shanghai (Trial) for Foreign High-End Talent (Category A), a commitment-based approach shall be adopted. Others meeting standards for Foreign High-End Talent (Category A) shall still provide proof of work experience. If the applicant has received well-known awards in the professional field, corresponding award certificates may be provided. Foreign Professional Talent (Category B) meeting the Occupation List for Urgently Needed Foreign Talent in Shanghai (Trial) shall submit proof documents matching the requirements.

4.最高学位(学历)证书及认证材料:最高学位(学历)证书在国外获得的,应经我驻外使、领馆或由申请人获得学位(学历)所在国驻华使、领馆或我国学历认证机构认证;最高学位(学历)证书在港澳特别行政区和台湾地区获得的,应经我国学历认证机构认证或经所在地区公证机构公证;最高学位(学历)证书在中国境内获得的,仅提供学历(学位)证书原件。

4. Highest Degree (Qualification) Certificate and Authentication Documents: If the highest degree (qualification) certificate is obtained abroad, it shall be authenticated by the Chinese embassy or consulate abroad, or by the embassy or consulate in China of the country where the degree was obtained, or by a recognized Chinese degree authentication agency. If the highest degree (qualification) certificate is obtained in the Hong Kong or Macao Special Administrative Region or the Taiwan region, it shall be authenticated by a Chinese degree authentication agency or notarized by a notarization agency in the respective region. If the highest degree (qualification) certificate is obtained within the Chinese mainland, only the original degree (qualification) certificate is required.

其中,涉及有学校排名要求的需提供学校所在榜单证明材料,优秀毕业生需提供相应成绩证明材料。

For cases involving school ranking requirements, proof of the school's ranking from an official list shall be provided. Outstanding graduates shall provide corresponding academic performance proof.

外国高端人才符合《外国人来华工作分类标准(试行)》《上海市外籍“高精尖”人才认定标准(试行)》外国高端人才(A类)(一)入选国内人才引进计划的;(二)符合国际公认的专业成就认定标准的;(三)符合市场导向的鼓励类岗位需求的外国人才;(四)创新创业人才;(七)经有关部门推荐人才的,该项采用承诺制。

For foreign high-end talent who (I) is selected under domestic talent introduction programs; (II) meets internationally recognized professional achievement standards; (III) meets market-oriented encouraged positions; (IV) is categorized as innovative and entrepreneurial talent; or (VII) is recommended by relevant departments, as defined in the Classification Standards for Foreigners Working in China (Trial) and the Recognition Standards for Highly Educated, Professionally Competent, and Cutting-Edge Foreign Talent in Shanghai (Trial) for Foreign High-End Talent (Category A), a commitment-based approach shall be adopted.

符合《上海市外籍“急需紧缺”人才岗位目录(试行)》的外国专业人才(B类)应提交与条件相符的证明材料。

Foreign Professional Talent (Category B) meeting the Occupation List for Urgently Needed Foreign Talent in Shanghai (Trial) shall submit proof documents matching the requirements.

5.相关批准文书、职业资格证明:我国法律法规规定应由行业主管部门前置审批或具备我国相应准入类职业资格的,应提供行业主管部门批准文书或职业资格证明;国外专业资格证明,应经我驻外使、领馆认证,或获得专业资格证明所在国的驻华使、领馆认证或公证机构对原件公证;职业资格证明在港澳特别行政区和台湾地区获得的,应经所在地区公证机关对原件公证。

5. Relevant Approval Documents and Professional Qualification Certificates: Where laws and regulations of China require prior approval by the competent industry authority or holding a corresponding Chinese entry-level professional qualification, the applicant shall provide the approval documents issued by the competent authority or the professional qualification certificate. Foreign professional qualification certificates shall be authenticated by the Chinese embassy or consulate abroad, or authenticated by the embassy or consulate in China or notarized by the notary authority of the country where the qualification was issued. Certificates obtained in the Hong Kong or Macao Special Administrative Region or the Taiwan region shall be notarized by the local notary authority.

6.无犯罪记录证明及认证材料:外国高端人才(A类)、“急需紧缺”人才(B类)和科技人才(B类)该项采用承诺制。 外国专业人才(B类)应当由申请人国籍国或经常居住地警察、安全、法院等部门出具,并经我驻外使、领馆认证或外国驻华使、领馆认证(经常居住地指申请人离开国籍国最后连续居住1年以上的国家或地区,不包括在中国境内);在港澳特别行政区和台湾地区出具的无犯罪记录证明,应经所在地区公证机关公证。 无犯罪记录签发时间应在6个月内。不接收仅为本人声明无犯罪的宣誓性无犯罪记录。外交(含外国驻华使、领馆)出具的非宣誓性无犯罪记录可直接接收,不再认证。

6. Certificate of No Criminal Record and Authentication Documents: For Foreign High-End Talent (Category A), Urgently Needed Talent (Category B), and Scientific and Technological Talent (Category B), a commitment-based approach shall be adopted for this item. For Foreign Professional Talent (Category B), the certificate of no criminal record shall be issued by the police, security authorities, or courts in the applicant's country of nationality or place of habitual residence, and authenticated by the Chinese embassy or consulate abroad or the embassy or consulate of the relevant country in China. "Habitual residence" refers to the country or region outside China where the applicant has resided continuously for more than one year after leaving their country of nationality. Certificates issued in the Hong Kong or Macao Special Administrative Region or the Taiwan region shall be notarized by the local notary authority. The certificate shall be issued within the last six months. Sworn statements of no criminal record made by the applicant alone shall not be accepted. Non-sworn certificates of no criminal record issued by diplomatic missions (including foreign embassies or consulates in China) may be accepted directly without further authentication.

7.体检证明:由中国检验检疫机构出具的境外人员体格检查记录验证证明或健康检查证明书,签发时间均在6个月内。境外申请《外国人来华工作许可》可采用承诺制并提供体检承诺书。

7. Medical Examination Certificate: A physical examination record verification certificate or health check certificate issued by a Chinese inspection and quarantine institution for foreign nationals shall be provided, and the date of issuance must be within the past six months. For overseas applications for the Foreigner's Work Permit in China, the commitment-based approach may be adopted where applicants can submit a Medical Examination Commitment Letter.

8.聘用合同或任职证明:应提供中文合同,应由申请人签名并加盖单位公章,不得涂改。聘用合同或任职证明(包括跨国公司派遣函)应当包括工作地点、工作内容、薪酬、来华工作时间、职位、盖章页(签字)必要内容。任职证明适用执行政府间、国际组织间协议或协定人员、各类驻华代表处首席代表及代表及境外合同服务提供者。派遣函适用情形为跨国公司总部或地区总部从境外派遣经理等高级管理人员和专业技术人员至境内子公司或分公司任职,由跨国公司总部或地区总部出具。任职证明(包括派遣函)如缺少必要内容,需另行出具证明补充说明。跨国公司在华地区总部派遣经理等高级管理人员和专业技术人员至境内子公司或分公司任职的,提交派遣函以及与跨国公司在华地区总部签订的聘用合同。

8. Employment Contract or Appointment Certificate: A Chinese version of the contract shall be provided. It must be signed by the applicant and affixed with the official seal of the employer. No alterations are allowed. The employment contract or appointment certificate (including assignment letters from multinational corporations) must include essential details such as the workplace, job duties, salary, duration of work in China, position, and the signature/seal page. An appointment certificate applies to personnel performing duties under intergovernmental or international organization agreements, chief representatives and representatives of various representative offices in China, and foreign contractual service providers. Assignment letters apply to cases where a multinational corporation headquarters or regional headquarters dispatches senior executives including managers or professional technical personnel from overseas to work at subsidiaries or branch offices in China. Such letters must be issued by the headquarters or regional headquarters of the multinational corporation. If the appointment certificate (including assignment letter) lacks any of the required information, a supplementary certificate shall be provided separately. For cases where a multinational corporation's regional headquarters in China dispatches senior executives including managers or professional technical personnel to subsidiaries or branch offices in China, both the assignment letter and the employment contract signed with the regional headquarters in China shall be submitted.

9.申请人护照或国际旅行证件:护照或国际旅行证件信息页。护照有效期不得少于6个月。

9. Applicant's Passport or International Travel Document: Information page of the passport or international travel document.

The passport must have a remaining validity of no less than six months.

10.申请人6个月内正面免冠照片:近期免冠电子照片,白色背景,无边框,面部特征完整,图像清晰,无斑点、瑕疵、印墨缺陷。不建议戴帽子或头巾等饰物,如因宗教原因不得不戴,应确保其不遮挡申请人整个面部。

10. Applicant's Front-Facing Bareheaded Photo Taken Within the Last six Months: A recent electronic photo with a white background, no border, full facial features visible, clear image, and free of spots, blemishes, or ink defects. Wearing hats or headscarves is not recommended. If required for religious reasons, the accessory must not cover the applicant's full face.

11.随行家属相关证明材料:包括随行家属护照(或国际旅行证件)信息页、家属关系证明(配偶:结婚证书,子女:子女出生证明或收养证明,父母或配偶父母:申请人出生证明或结婚证书或公证证明)、体检报告(18周岁以上家属)以及电子照片(要求与主申请人一致)。随行家属包括配偶、未年满18周岁的子女、父母及配偶父母。

11. Supporting Documents for Accompanying Family Members: These include the information page of the passport (or international travel document) of the accompanying family members; proof of family relationship (for spouse: marriage certificate; for children: birth certificate or adoption certificate; for parents or spouse's parents: applicant's birth certificate, marriage certificate, or notarized certificate); medical examination report (for family members aged 18 and above); and electronic photo (same requirements as for the principal applicant). Accompanying family members include spouse, children under the age of 18, parents, and spouse's parents.

12.其他材料:许可受理机构或决定机构根据需要要求进行补充提供的材料。

12. Other Documents: Additional documents as required by the acceptance or decision-making authority based on specific needs.

(二)境内申请《外国人来华工作许可》

(II) Domestic Application for the Foreigner's Work Permit in China

1.外国人来华工作许可申请表:在线填写打印,申请人签字后,加盖用人单位公章或经单位授权部门公章上传至系统。

For foreign high-end talent who (I) is selected under domestic talent introduction programs or (II) meets internationally recognized professional achievement standards, as defined in the Classification Standards for Foreigners Working in China (Trial) and the Recognition Standards for High-Level, Highly Skilled, and Advanced Foreign Talent in Shanghai (Trial) for Foreign High-End Talent (Category A), a commitment-based approach shall be adopted. Others meeting standards for Foreign High-End Talent (Category A) shall still provide proof of work experience. If the applicant has received well-known awards in the professional field, corresponding award certificates may be provided. Foreign Professional Talent (Category B) meeting the Occupation List for Urgently Needed Foreign Talent in Shanghai (Trial) shall submit proof documents matching the requirements.

4.最高学位(学历)证书及认证材料:最高学位(学历)证书在国外获得的,应经我驻外使、领馆或由申请人获得学位(学历)所在国驻华使、领馆或我国学历认证机构认证;最高学位(学历)证书在港澳特别行政区和台湾地区获得的,应经我国学历认证机构认证或经所在地区公证机构公证;最高学位(学历)证书在中国境内获得的,仅提供学历(学位)证书原件。

4. Highest Degree (Qualification) Certificate and Authentication Documents: If the highest degree (qualification) certificate is obtained abroad, it shall be authenticated by the Chinese embassy or consulate abroad, or by the embassy or consulate in China of the country where the degree was obtained, or by a recognized Chinese degree authentication agency. If the highest degree (qualification) certificate is obtained in the Hong Kong and Macao Special Administrative Regions or the Taiwan region, it shall be authenticated by a Chinese degree authentication agency or notarized by a notarization agency in the respective region. If the highest degree (qualification) certificate is obtained within the Chinese mainland, only the original degree (qualification) certificate is required.

其中,涉及有学校排名要求的需提供学校所在榜单证明材料,优秀毕业生需提供相应成绩证明材料。

For cases involving school ranking requirements, proof of the school's ranking from an official list shall be provided. Outstanding graduates shall provide corresponding academic performance proof.

符合《外国人来华工作分类标准(试行)》《上海市外籍“高精尖”人才认定标准(试行)》外国高端人才(A类)(一)入选国内人才引进计划的;(二)符合国际公认的专业成就认定标准的;(三)符合市场导向的鼓励类岗位需求的外国人才;(四)创新创业人才;(七)经有关部门推荐人才的,该项采用承诺制。

For foreign high-end talent who (I) is selected under domestic talent introduction programs; (II) meets internationally recognized professional achievement standards; (III) meets market-oriented encouraged positions; (IV) is categorized as innovative and entrepreneurial talent; or (VII) is recommended by relevant departments, as defined in the Classification Standards for Foreigners Working in China (Trial) and the Recognition Standards for High-Level, Highly Skilled, and Advanced Foreign Talent in Shanghai (Trial) for Foreign High-End Talent (Category A), a commitment-based approach shall be adopted.

符合《上海市外籍“急需紧缺”人才岗位目录(试行)》的外国专业人才(B类)应提交与条件相符的证明材料。

Foreign Professional Talent (Category B) meeting the Occupation List for Urgently Needed Foreign Talent in Shanghai (Trial) shall submit proof documents matching the requirements.

5.相关批准文书、职业资格证明:我国法律法规规定应由行业主管部门前置审批或具备我国相应准入类职业资格的,应提供行业主管部门批准文书或职业资格证明;国外专业资格证明,应经我驻外使、领馆认证,或获得专业资格证明所在国的驻华使、领馆认证或公证机构对原件公证;职业资格证明在港澳特别行政区和台湾地区获得的,应经所在地区公证机关对原件公证。

5. Relevant Approval Documents and Professional Qualification Certificates: Where laws and regulations of China require prior approval by the competent industry authority or holding a corresponding Chinese entry-level professional qualification, the applicant shall provide the approval documents issued by the competent authority or the professional qualification certificate. Foreign professional qualification certificates shall be authenticated by the Chinese embassy or consulate abroad, or authenticated by the embassy or consulate in China or notarized by the notary authority of the country where the qualification was issued. Certificates obtained in the Hong Kong or Macao Special Administrative Region or the Taiwan region shall be notarized by the local notary authority.

6.无犯罪记录证明及认证材料:外国高端人才(A类)、“急需紧缺”人才(B类)和科技人才(B类)该项采用承诺制。 外国专业人才(B类)应当由申请人国籍国或经常居住地警察、安全、法院等部门出具,并经我驻外使、领馆认证或外国驻华使、领馆认证(经常居住地指申请人离开国籍国最后连续居住1年以上的国家或地区,不包括在中国境内);在港澳特别行政区和台湾地区出具的无犯罪记录证明,应经所在地区公证机关公证。 无犯罪记录签发时间应在6个月内。不接收仅为本人声明无犯罪的宣誓性无犯罪记录。外交(含外国驻华使、领馆)出具的非宣誓性无犯罪记录可直接接收,不再认证。

6. Certificate of No Criminal Record and Authentication Documents: For Foreign High-End Talent (Category A), Urgently Needed Talent (Category B), and Scientific and Technological Talent (Category B), a commitment-based approach shall be adopted for this item. For Foreign Professional Talent (Category B), the certificate of no criminal record shall be issued by the police, security authorities, or courts in the applicant's country of nationality or place of habitual residence, and authenticated by the Chinese embassy or consulate abroad or the embassy or consulate of the relevant country in China. "Habitual residence" refers to the country or region outside China where the applicant has resided continuously for more than one year after leaving their country of nationality. Certificates issued in the Hong Kong or Macao Special Administrative Region or the Taiwan region shall be notarized by the local notary authority. The certificate shall be issued within the last six months. Sworn statements of no criminal record made by the applicant alone shall not be accepted. Non-sworn certificates of no criminal record issued by diplomatic missions (including foreign embassies or consulates in China) may be accepted directly without further authentication. 

原则上,工作类居留许可在有效期内可以免提供无犯罪记录证明;如外国人更换单位,公安出入境机构已将工作类居留许可注销,并换成了停留签证;如外国人未出境,且工作类居留许可注销一个月内,也可免提供无犯罪记录证明。

In principle, a work-related residence permit shall exempt the submission of a certificate of no criminal record during its validity period. If a foreigner changes employer and the Public Security Exit-Entry Administration cancels the work-related residence permit and replaces it with a residence visa, the certificate of no criminal record shall also be exempted. If the foreigner has not left the country and the work-related residence permit was canceled within one month, the certificate of no criminal record shall likewise be exempted.

7.体检证明:由中国检验检疫机构出具的境外人员体格检查记录验证证明或健康检查证明书,签发时间均在6个月内。境内申请《外国人来华工作许可》持有效的居留许可免提供体检证明(获得来华工作90日以下的工作类居留许可的仍需提供)。

7. Medical Examination Certificate: A physical examination record verification certificate or health check certificate issued by a Chinese inspection and quarantine institution for foreign nationals shall be provided, and the date of issuance must be within the past six months. For domestic applications for the Foreigner's Work Permit in China, applicants holding a valid residence permit shall be exempt from providing a medical examination certificate (Those holding a work-related residence permit valid for less than 90 days are still required to provide it).

8.聘用合同或任职证明:应提供中文合同,应由申请人签名并加盖单位公章,不得涂改。聘用合同或任职证明(包括跨国公司派遣函)应当包括工作地点、工作内容、薪酬、来华工作时间、职位、盖章页(签字)必要内容。任职证明适用执行政府间、国际组织间协议或协定人员、各类驻华代表处首席代表及代表及境外合同服务提供者。派遣函适用情形为跨国公司总部或地区总部从境外派遣经理等高级管理人员和专业技术人员至境内子公司或分公司任职,由跨国公司总部或地区总部出具。任职证明(包括派遣函)如缺少必要内容,需另行出具证明补充说明。跨国公司在华地区总部派遣经理等高级管理人员和专业技术人员至境内子公司或分公司任职的,提交派遣函以及与跨国公司在华地区总部签订的聘用合同。

8. Employment Contract or Appointment Certificate: A Chinese version of the contract shall be provided. It must be signed by the applicant and affixed with the official seal of the employer. No alterations are allowed. The employment contract or appointment certificate (including assignment letters from multinational corporations) must include essential details such as the workplace, job duties, salary, duration of work in China, position, and the signature/seal page. An appointment certificate applies to personnel performing duties under intergovernmental or international organization agreements, chief representatives and representatives of various representative offices in China, and foreign contractual service providers. Assignment letters apply to cases where a multinational corporation headquarters or regional headquarters dispatches senior executives including managers or professional technical personnel from overseas to work at subsidiaries or branch offices in China. Such letters must be issued by the headquarters or regional headquarters of the multinational corporation. If the appointment certificate (including assignment letter) lacks any of the required information, a supplementary certificate shall be provided separately. For cases where a multinational corporation's regional headquarters in China dispatches senior executives including managers or professional technical personnel to subsidiaries or branch offices in China, both the assignment letter and the employment contract signed with the regional headquarters in China shall be submitted.

9.申请人护照或国际旅行证件:护照或国际旅行证件信息页。护照有效期不得少于6个月。

The passport must have a remaining validity of no less than six months.

10.申请人有效签证或有效居留许可:护照(或国际旅行证件)签证页、最近的入境签章页或居留许可信息页。

10. Applicant's Valid Visa or Residence Permit: The visa page and the most recent entry stamp page of the passport (or international travel document), or residence permit information page.

11.申请人6个月内正面免冠照片:近期免冠电子照片,白色背景,无边框,面部特征完整,图像清晰,无斑点、瑕疵、印墨缺陷。不建议戴帽子或头巾等饰物,如因宗教原因不得不戴,应确保其不遮挡申请人整个面部。

11. Applicant's Front-Facing Bareheaded Photo Taken Within the Last Six Months: A recent electronic photo with a white background, no border, full facial features visible, clear image, and free of spots, blemishes, or ink defects. Wearing hats or headscarves is not recommended. If required for religious reasons, the accessory must not cover the applicant's full face.

12.注销单或离职证明:如申请人变换用人单位或岗位的,《外国人来华工作许可》在有效期内,应先行注销现有工作许可。

12. Cancellation Notice or Resignation Certificate: If the applicant changes employer or position, the existing Foreigner's Work Permit in China shall be canceled in advance during its validity period. If the employment contract is lawfully terminated and the applicant changes employer within one year while remaining in China to apply for a Foreigner’s Work Permit in China, a resignation certificate from the previous employer shall be provided.

13.其他材料:许可受理机构或决定机构根据需要要求进行补充提供的材料。

《外国人来华工作许可》全程网上办理(新办需核验申请材料原件),申请人入境时需携带所有材料原件。境外申请的,获得工作许可入境后一个月内办理工作居留许可之前持材料原件至受理机构做好材料核验工作;境内申请的,应在预审通过后持申报材料原件至受理机构做好材料核验工作。

The Foreigner's Work Permit in China is processed entirely online (Original application documents must be verified for new applications). Applicants shall bring all original documents upon entry into China. For overseas applications: after obtaining the work permit and entering China, the applicant shall present the original documents to the accepting authority for verification within one month and before applying for the residence permit for work. For domestic applications: after passing the pre-review, the applicant shall bring the original documents to the accepting authority for verification.
