大庆外国人在华办理工作签证需要哪些手续和资料?

现在越来越多外国人想要在中国工作和生活，也很多公司想要聘请外国人工作。按照《中华人民共和国出境入境管理法》第四十一条，外国人在中国境内工作，应当按照规定取得工作许可和工作类居留证件。任何单位和个人不得聘用未取得工作许可和工作类居留证件的外国人。意思就是，工作签证由这两个构成，如果缺少一个，外国人都不能在中国工作。那么，外国人在华办理工作签证需要哪些手续和资料?

一．大庆用人单位聘用外国人应具备哪些条件？

依法设立，无严重违法失信记录，聘用外国人从事的岗位应是有特殊需要，国内暂缺适当人选，且不违反国家有关规定，支付所聘用外国人的工资、薪金不得低于当地最低工资标准。法律法规规定应由行业主管部门前置审批的，需经过批准。

意思就是: 1. 具备营业执照、纳税情况正常及无经营异常；2. 岗位上的特殊需要，比如：面对中国国内的销售人员岗位，中文老师等，这些岗位国人完全可以胜任的,无需聘请外国人。3. 薪资方面在当地最低工资标准起步。

It means: 1. Having a business license, normal tax payment and no business abnormality; 2. The special needs of the post, such as, in the face of domestic sales staff posts, Chinese teachers, etc., Chinese people are fully qualified for these posts, no need to hire foreigners. 3. In terms of salary, the salary shall not be lower than the local minimum wage standard.

用人单位需要提供的资料: 营业执照、法人身份信息、公司纳税信息、办公地址租赁凭证或合同等。

Information to be provided by the employer: business license, legal person identity information, company tax information, office address lease voucher or contract, etc.

二．大庆外国人在中国工作须具备哪些条件呢？

What are the conditions for foreigners to work in China?

根据《外国人在中国就业管理规定》第七条，外国人在中国就业需具备下列条件：

1. 年满18周岁，身体健康；

2. 具有从事其工作所必须的专业技能和相应的工作经历；

3. 无犯罪记录；

4. 有确定的聘用单位；

5. 持有有效护照或能代替护照的其他国际旅行证件。

According to Article 7 of the regulations on the administration of foreigners' employment in China, foreigners must meet the following conditions for employment in China:

1. At least 18 years old and in good health;

2. Have the professional skills and corresponding work experience necessary for their work;

3. No criminal record;

4. There is a definite employing unit;

在此基础上，按照“鼓励高端、控制一般、限制低端”的原则，外国人分为外国高端人才(A类)、外国专业人才(B类)和其他外国人才(C类)。

外国高端人才（A类）是指符合“高精尖缺”和市场需求导向，中国经济社会发展需要的科学家、科技领军人才、国际企业家、专门特殊人才等，以及符合计点积分外国高端人才标准。外国高端人才可不受年龄和工作经历限制。

外国专业人才（B类）是指要符合外国人来华工作指导目录和岗位需求，以及符合计点积分外国专业人才标准，应当不超过60周岁，具有学士及以上学位和2年及以上相关工作经历；确有需要的，可适当放宽年龄、学位或工作经历等限制。

外国就业者需提供的资料：护照，最高学历证明文件，相关工作经历证明文件，无犯罪证明文件，体检报告等。

三．大庆申请手续/流程（以大庆市，首次申请工作签证为例）

Application procedures / processes (take Shenzhen as an example for the first time to apply for a work visa)

1. 用人单位登录深圳市外国人综合服务管理平台，完善单位备案信息；

2. 用人单位在平台上申请外国人来华工作许可通知；

3. 外国就业者在境外就可以在中国驻外国领事馆申请Z签(相当于临时工作签证)，然后入境中国

4. 入境后，用人单位在平台上申请外国人工作许可证和工作类居留许可（就是工作签证）

外国就业者已在境内的，符合一定条件的，可以直接申请办理外国人工作许可证及工作类居留许可；不符合直接办理外国人工作许可证情形的，但已入境的外国就业者，仍须按新办《外国人工作许可通知》程序办理。
