外国人人在境内，如何办理来华工作许可？

符合下列情形之一的，可在境内直接申请外国人来华工作许可：

Those who meet one of the following conditions can directly apply for a foreigner's work permit in China:

（1）持其他签证或有效居留证件已入境的外国高端人才（A类）；

（2）在华工作的外国人变换用人单位，但工作岗位（职业）未变动，且工作类居留许可在有效期内的；

（3）中国公民的外籍配偶或子女、在华永久居留或工作的外国人的配偶或子女，持有效签证或在有效期内的居留许可的；

（4）符合自由贸易区、全面创新改革试验区相关优惠政策的；

（5）用人单位符合享有跨国公司在华地区总部相关优惠政策的；

（6）企业集团内部人员流动的；

（7）执行政府间协议或协定的；

（8）已持工作签证依法入境的驻华机构代表人员；已获得来华工作90日以下的外国人来华工作许可，在其停留有效期内，被境内用人单位依法聘用的；

（9）其他审批机构认定符合条件的。

(1) Foreign high-end talents (Class A) who have entered China with other visas or valid residence certificates;

(2) Foreigners working in China change their employers, but their job (occupation) has not changed, and the work residence permit is within the validity period;

(3) The foreign spouse or children of Chinese citizens, or the spouse or children of foreigners who permanently reside or work in China, hold a valid visa or residence permit within the valid period;

(4) Those in line with the relevant preferential policies of the free trade zone and the comprehensive innovation and reform pilot zone;

(5) The employer meets the relevant preferential policies of the regional headquarters of multinational companies in China;

(6) Personnel flow within the enterprise group;

(7) Implementation of intergovernmental agreements or agreements;

(8) Representatives of agencies in China who have entered China with work visas according to law; Foreigners who have obtained a work permit to work in China for less than 90 days are legally employed by domestic employers within the valid period of their stay;

(9) Other examination and approval authorities deem it qualified.

若不符合以上情形，但人已入境，则须按境外申请外国人来华工作许可程序办理。

If the above conditions are not met, but the person has entered the country, it shall be handled according to the procedures for applying for a foreigner's work permit in China from abroad.
